TERMS AND CONDITIONS OF USE
AIR RAIL, S.L., complies with the requirements established in the Law 34/2002, of July 11, of Services of the Society of the Information and Electronic Commerce and other European directives and to this end has created the following Legal Notice.
AIR RAIL, S.L., informs you that the use of the portal, including mere access, confers the condition of User. In this sense, the User undertakes to use the portal in accordance with the law, this Legal Notice, regulations and instructions made known to him/her, as well as morality, generally accepted good customs and public order. If the user does not agree with any of the conditions set forth herein, he/she should not use/access this portal.
Intellectual and industrial property
This Legal Notice does not grant any intellectual or industrial property rights over the website or any of its constituent elements.
All the Contents of the present portal, understanding by these merely by way of example the texts, photographs, graphics, images, icons, technology, software, links and other audiovisual or sound contents, as well as its graphic design and source codes, and the intellectual property rights that may correspond to such contents, as well as all trademarks, trade names or any other distinctive sign, are the property of AIR RAIL. S.L., or of their legitimate owners, being reserved all the rights on the same ones and without being able to be understood yielded to the User none of the rights of exploitation on the same ones, beyond the strictly necessary thing for the correct use of the Portal; they are therefore protected by the regulation of Intellectual and Industrial Property, in particular by the R.D.L 1/96 that approves the Revised Text of the Law of Intellectual Property and by the Law of Marks 17/2001.
The User is prohibited from any act of reproduction, transformation, distribution, public communication, making available, extraction, reuse, resending or use of any nature, by any means or procedure, of any of the Contents, except in those cases in which it is legally permitted or authorized in writing by the holder of the corresponding rights.
AIR RAIL, S.L., will not be liable for any damages that may arise from the use of the Contents by the users or the infringement by them of any legal provision in force.
CONTENTS
AIR RAIL, S.L., reserves the right to make unannounced changes it deems appropriate in the portal, may change, delete or add content and services it provides as well as the way in which they are presented or located.
The User of the portal undertakes to make correct use of the Portal and its Contents in accordance with the Law and this Legal Notice, and not to use them for illicit activities or activities contrary to good faith and legal order, and not to cause damage to the physical and logical systems of AIR RAIL, S.L., its suppliers or third parties.
The User will be liable to AIR RAIL, S.L., or to third parties, for any damages that may be caused as a result of the breach of this obligation.
DISCLAIMER OF WARRANTIES AND LIABILITY
CONTINUITY OF SERVICES
Access to the Portal requires services and supplies from third parties, including transport through telecommunications networks whose reliability, quality, continuity and operation AIR RAIL, S.L. is not responsible for.
Therefore, AIR RAIL, S.L., does not guarantee the availability and continuity of the operation of the Portal, the Services and/or the Contents, not assuming any liability for damages of any kind that may be due to the lack of such availability or continuity.
2.- PORTAL SECURITY
AIR RAIL, S.L., adopts reasonably adequate security measures, but cannot guarantee the absolute invulnerability of the security systems of the Portal and the Services, nor can it guarantee the security or inviolability of such data in its transmission through the network; the User must be aware that the security measures of computer systems on the Internet are not entirely reliable.
It excludes, therefore, all liability for damages of any kind that may be due to the knowledge that unauthorized third parties may have of the type, conditions, characteristics and circumstances of the users of the Portal, the Services and/or the Contents.
AIR RAIL, S.L., does not control or guarantee the absence of viruses, worms, or other elements in the Contents that may cause alterations in your computer system (hardware and software) or in the electronic documents and files stored in your computer system. It is up to the User, in any case, the availability of adequate tools for the detection and disinfection of harmful computer programs.
AIR RAIL, S.L., excludes all liability for damages of any kind that may be due to the presence of these viruses or harmful elements in the Contents.
3.- USE BY THE USER
AIR RAIL, S.L., does not control the use that the users make of the Portal, the Services and/or the Contents, so it does not guarantee that the use by the users is made in accordance with the law and the present general conditions. AIR RAIL, S.L., excludes any liability for damages of any kind that may be due to the use of the Portal, the Services and the Contents by the users.
Applicable legislation
This Legal Notice is governed in each and every one of its ends by Spanish Law, the parties expressly waiving the jurisdiction that corresponds to them, and submitting to the Courts and Tribunals of Madrid.
